Assault

simple assault/ assault bodily harm/ aggravated assault

The definition of assault is found in the Criminal Code at section 265.  An assault occurs when a person directly or indirectly applies force intentionally to another person, or who attempts or threatens to do so without consent.

This is one of the most common offences that Adam Weisberg handles as a criminal lawyer in Toronto.  Allegations of assault can occur in many contexts from bar room brawls to allegationsof domestic assault inside or outside the family home.

There are many defences available to a person that is alleged to have committed an assault.  Accidental contact, consent where there is no bodily harm, mistaken belief in consent where there is no bodily harm, and self-defence are the most common defences to assault.

Allegations of assault are very fact specific.  An experienced lawyer like Adam Weisberg is required to assess the allegation against you to determine which defences may be available to you.  If you have been charged with an assault don't hesitate to contact Adam Weisberg for a consultation.
